Employers have a legal responsibility to not only communicate but to consult with its workforce on OHS issues.  This needs to be capable of demonstration. Medium to large businesses may have nominated a person responsible for OHS within the workplace but these may not have the initial and ongoing specialist training in OHS and keeping abreast of all the requirements of the various Acts and regulations can be daunting.

Many small businesses are not fully aware of their responsibilities and/or are ill equipped and resourced to be able to develop and maintain their own safety management systems and monitoring processes. OHS legislation, unlike unfair dismissal laws, makes no real concessions for small business. Companies/Body Corporations, regardless of size, must develop and implement a system of overall safety compliance through documented policies, procedures and relevant training.
